Prostitution Stings in Houston

Definition of Prostitution

Under Section 43.02 of the Texas Penal Code, a person is guilty of prostitution when he/she:

  1. offers or agrees to pay a fee in exchange for sexual conduct, or

  2. agrees to receive a fee in exchange for sexual conduct.

 

The key term is "agreement". Prostitution becomes a 2nd degree felony if the actor with whom the accused engages in sexual conduct with:

  1.  is under 18 years of age;

  2. represented to the actor as being under 18 years of age; or

  3. believed by the actor to be under 18 years of age.
